(LifeSiteNews) — A lawsuit between California parents and their school district has finally been settled after securing a commitment to provide parental notifications and opt-outs before exposing children to any school materials concerning gender ideology or otherwise undermining religious beliefs.

Controversy arose in 2024 over Encinitas Union School District (EUSD) exposing fifth graders to My Shadow Is Pink, a 2021 picture book by Scott Stuart about an effeminate boy who embraces his “shadow,” with his father’s eventual blessing, by wearing a dress to school. La Costa Heights Elementary School principal Christie Kay initially doubled down in an email to parents, declaring that “LCH has a long-standing tradition of inclusion and a beautiful sense of community,” but “recent divisiveness in our school community regarding books and curriculum is disheartening. It is incumbent upon all of us to remind ourselves of the importance of making space for a variety of perspectives and viewpoints.”

But parents Carlos and Jenny Encinas sued, and in May 2025 secured a preliminary injunction against the district, which determined that schools cannot compel students to violate their religious consciences and that schools must provide advance notice and opt-out where religious beliefs are concerned. The district abandoned its appeal last November, letting that ruling stand.

Now, First Liberty Institute, which represented the parents, reported that it and National Center for Law & Policy have agreed to end the lawsuit after EUSD agreed to adopt parental notification and opt-out.

“No child should be forced to speak a message that violates his religious convictions,” First Liberty attorney Nate Kellum said. “We are grateful that we were able to reach this settlement on behalf of the families involved. This is a tremendous victory not only for our clients but for all parents in the Encinitas Union School District.”

“I would say the bare minimum is it puts other school districts in California and outside of California on notice,” Kellum added to The Center Square. “It’s a warning that because things did not go well for Encinitas Union School District, I think it should cause other school districts to pause before going forward with anything like this.”  

The indoctrination of children with left-wing ideology on sexuality and other agenda items has long been a major concern in American schools and libraries, from book shelves to drag events to classroom materials to even “transitioning” troubled children without parental input. Many schools have also displayed hostility to the rights and employment of individual teachers who refuse to go along with such agendas. Across the nation, controversy has also erupted in recent years over schools and libraries adopting books that attempt to expose sexual themes and activity to children, often in graphic detail and with pornographic imagery depicting specific sex acts.

This was not the first such controversy involving Encinitas Union pushing adult LGBT themes on children. In 2022, the district came under fire for sending out a Halloween party flyer featuring a “family friendly” drag show that was sponsored by a San Francisco “gender reassignment” clinic and a gay nightclub. The district eventually pulled the flyer, admitting it did “not mee(t) district approval criteria.”
